Terms & Conditions

By enrolling a young person in the Super 8 Acting Academy Young Actors programme, you (the “Parent/Guardian”) confirm that you have read, understood, and agree to these Terms & Conditions on behalf of the participant (the “Member”). This is a legally binding agreement between the Parent/Guardian and Matthew Bearne (the “Proprietor”).

Where a Member is aged 16 or over and enrols themselves with parental consent, references to “you” and “Parent/Guardian” in these Terms include the Member, save that the Parent/Guardian remains responsible for payment of fees unless otherwise agreed with the Proprietor in writing.

Super 8 Acting Academy is the trading style of Matthew Bearne, sole trader, under which the Young Actors programme (including the Fleet Class) operates for participants aged 11–18. Matthew Bearne also operates Super 8 Company (the adult strand, for participants aged 18 and over) and Actor Showreels by Matthew Bearne. Any contract formed is a contract with Matthew Bearne as an individual, who is solely responsible for all obligations and liabilities arising from these trading names.

These Terms & Conditions govern enrolment in the 11–18 Young Actors programme only and are separate from the Super 8 Company Terms & Conditions applicable to adult (18+) members. If you are enrolling as an adult member, please request the separate Super 8 Company Terms & Conditions.

1. The Programme

The Young Actors – Fleet Class offers craft-focused actor training for 11–18 year-olds based on a drama school methodology, adapted to age and experience, including:

  • Scene study and text work appropriate to age and experience

  • Ensemble and company-based working

  • Termly showcase performances for invited audiences

  • Occasional workshops, filmmaking projects and guest sessions

Classes take place on Tuesday evenings, 17.00–20.15, at Court Moor School, Fleet. Given the age range covered, Members are allocated to a specific group and session time within these hours, confirmed at enrolment. The school year is divided into three terms of twelve sessions each (36 sessions per year). Term dates will be confirmed in writing at the start of each academic year.

2. Fees & Payment

The membership fee is £49 per calendar month, payable by standing order or bank transfer on or before the 1st of each month.

Fees are spread equally across 12 calendar months regardless of term dates, including August, when Court Moor School is closed. This means monthly payments remain consistent throughout the year, including during school holiday periods.

If a Member joins partway through a term, the fee for that first part-month will be calculated on a pro-rata basis.

Payment is due whether or not sessions are attended. No refunds or credits are given for missed individual sessions, save as set out in Section 5 (Cancelled or Rescheduled Sessions).

If a payment is not received by the 7th of the month in which it is due, the Proprietor reserves the right to suspend membership until payment is made.

Fees are reviewed annually. Parents/Guardians will be given a minimum of one full term's notice of any fee increase.

3. Your Right to Cancel (Cooling-Off Period)

If you enrol at a distance — for example online, by email or by telephone — you have a statutory right to cancel the enrolment within 14 calendar days of the date you enrol, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel within this period, notify the Proprietor in writing at matthewbearne@hotmail.com.

If you ask for classes to begin before the 14-day period has ended and then cancel within that period, you may be charged a reasonable amount for any sessions already provided.

This cooling-off right is in addition to, and does not affect, your rights under Section 4 (Ongoing Cancellation & Notice) below.

4. Ongoing Cancellation & Notice

To cancel membership after the cooling-off period has ended, you must give one full term's written notice by email to matthewbearne@hotmail.com. Notice must be received before the first session of the term in which you wish membership to end.

Notice given mid-term will take effect at the end of the following term. Monthly payments continue to be payable until the final calendar month of the notice period.

The Proprietor reserves the right to terminate membership with immediate effect in cases of conduct that breaches Section 6 (Behaviour & Professional Conduct) of these Terms, or in circumstances where continued membership is not in the best interests of the Member or the group.

5. Cancelled or Rescheduled Sessions

In the event of a session being cancelled by the Proprietor due to illness, venue unavailability (including unplanned school closure), or other unforeseen circumstances, reasonable efforts will be made to reschedule the session within the same term.

Where a session cannot be rescheduled, a credit will be applied to the following month's payment. No cash refunds will be issued, save where required under Section 3 (Your Right to Cancel) or applicable consumer law.

6. Behaviour & Professional Conduct

Super 8 Acting Academy operates as a professional, supportive ensemble environment. All Members are expected to:

  • Treat all fellow Members, the Proprietor, and school staff with respect

  • Arrive punctually and prepared

  • Engage constructively with direction and feedback

  • Maintain confidentiality regarding the personal work shared by other Members in sessions

  • Refrain from recording sessions (audio or video) without explicit written consent

  • Follow any site-specific rules communicated by Court Moor School while on its premises

Zero tolerance applies to bullying, discrimination, harassment or aggressive behaviour toward any person, including on grounds of any protected characteristic under the Equality Act 2010 — namely age, disability, gender reassignment, marriage or civil partnership, pregnancy or maternity, race, religion or belief, sex, and sexual orientation. Where a Member's conduct raises concern, the Proprietor will normally discuss this with the Parent/Guardian in the first instance. Membership may be terminated with immediate effect only in cases of serious misconduct, or where continued participation is not in the best interests of the Member or the group, following the process set out in Section 14 (Complaints Procedure) where practicable.

7. Intellectual Property

Any original workshop materials, scene adaptations, or exercises created by the Proprietor remain the intellectual property of Matthew Bearne. Members and Parents/Guardians may not reproduce, distribute, or use these materials for commercial purposes without written permission.

8. Media, Photography & Data Protection

Photographs and video footage may be taken during sessions and showcases for promotional use across Super 8 Acting Academy's marketing channels, including social media and the website. Because these images are of children and young people, the Proprietor will seek the Parent/Guardian's specific written consent as part of the enrolment process before any image or footage of a Member is used in this way, rather than relying on an assumed consent.

Consent can be withdrawn at any time by writing to matthewbearne@hotmail.com. Withdrawing consent will not affect the Member's place in classes.

Personal data (including any medical or safeguarding information provided under Sections 11 and 13) is held and processed in accordance with UK GDPR and the Data Protection Act 2018. Data is used only for purposes connected with the Member's participation — including administration, communication, safeguarding and, where consented, promotion — and will not be shared with third parties except where required by law or necessary to protect a Member's welfare. A Parent/Guardian may ask at any time what personal data is held about their Member, ask for it to be corrected, or ask for it to be deleted, by writing to matthewbearne@hotmail.com.

9. Equality, Diversity & Inclusion

Super 8 Acting Academy is committed to providing an inclusive environment in which all Members are treated fairly and with dignity, regardless of any protected characteristic under the Equality Act 2010, including sex, sexual orientation, gender reassignment, race, religion or belief, disability, and age.

Members' correct names and pronouns will be used and respected. This is a values commitment made by the Proprietor and does not itself alter the legal meaning of terms used in the Equality Act 2010, which — following the Supreme Court's judgment in For Women Scotland Ltd v The Scottish Ministers [2025] UKSC 16 — defines ‘sex’ by reference to biological sex for the purposes of that Act. Gender reassignment remains a separate protected characteristic in its own right, and harassment, discrimination or victimisation of any Member on that or any other ground will not be tolerated.

As a provider of services to the public, the Proprietor is subject to the reasonable adjustments duty under Part 3 of the Equality Act 2010 — see Section 11 (Health, Medical Conditions, Allergies & Disability) below.

10. Health, Medical Conditions, Allergies & Disability

As part of enrolment, Parents/Guardians are responsible for disclosing any medical conditions, allergies, injuries, or accessibility requirements affecting a Member's participation, together with up-to-date emergency contact details. This information will be held confidentially and in accordance with Section 9 (Media, Photography & Data Protection), and it is the Parent/Guardian's responsibility to keep it current.

The Proprietor will, so far as is reasonable and practicable for a sole-trader business of this size, make reasonable adjustments to enable disabled Members to participate, in line with the Equality Act 2010. Parents/Guardians are encouraged to raise any access requirements before enrolling, or at any time during membership, so that these can be discussed.

By enrolling, the Parent/Guardian consents to the Proprietor administering basic first aid to the Member if required, and to the Proprietor contacting the Parent/Guardian and/or emergency services in the event of illness, injury, or a medical emergency.

The Proprietor reserves the right to exclude a Member from a physical activity if it appears that participation poses a risk to their health or the safety of others. Any such decision will be made following consultation with the Parent/Guardian wherever reasonably possible, and will not be applied in a way that amounts to unlawful discrimination under the Equality Act 2010.

11. Supervision, Drop-off & Collection

Members are supervised by the Proprietor for the duration of their session. Outside of session times, responsibility for the Member's safe travel to and from Court Moor School rests with the Parent/Guardian.

Members under 16 must be collected by a parent/guardian or another nominated adult, unless the Parent/Guardian has given the Proprietor written permission for the Member to travel to or from sessions independently. Parents/Guardians should notify the Proprietor promptly if collection arrangements change.

 

12. Safeguarding & Child Protection

The safety and welfare of every Member is the Proprietor's first priority. Super 8 Acting Academy is committed to safeguarding children and young people in line with the Children Act 1989 and 2004 and the statutory guidance Keeping Children Safe in Education and Working Together to Safeguard Children.

 

13. Complaints Procedure

If you have a concern or complaint about any aspect of the programme, please raise it in the first instance, in writing, to matthewbearne@hotmail.com. The Proprietor will acknowledge your complaint within 5 business days and aim to provide a full written response within 14 days.

Where a complaint concerns an alleged breach of Section 6 (Behaviour & Professional Conduct) or Section 10 (Equality, Diversity & Inclusion), it will be investigated impartially, and those concerned will be given an opportunity to respond before any decision is made. Where a complaint raises a safeguarding concern, it will be handled under Section 13 (Safeguarding & Child Protection) instead of, or in addition to, this procedure.

If a complaint cannot be resolved directly, Parents/Guardians may also contact the Citizens Advice consumer helpline for independent guidance on consumer matters.

 

14. Liability

Super 8 Acting Academy accepts no liability for loss or damage to personal belongings at the venue.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for any matter where it would be unlawful to exclude liability under the Consumer Rights Act 2015 or other applicable legislation.

 

15. Changes to These Terms

The Proprietor reserves the right to update these Terms & Conditions. Parents/Guardians will be notified of any material changes by email, with a minimum of 30 days' notice before changes take effect.

 

16. Governing Law

These Terms & Conditions are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
